These Terms of Service ("Terms") constitute a legally binding agreement between you ("Candidate", "you", or "your") and Open CVNGN ("Company", "we", "us", or "our"), governing your participation in video interviews conducted through the Open CVNGN platform (the "Service").
By participating in a video interview through our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you should not proceed with the interview.
For the purposes of these Terms:
Open CVNGN provides a platform that:
4.1 You must be at least 18 years of age to use the Service, or the minimum age required to consent to data processing in your jurisdiction.
4.2 You must have the legal right to work in the jurisdiction for which you are applying.
5.1 Recording Consent: By proceeding with the interview, you consent to the audio and video recording of your interview session.
5.2 AI Processing: You acknowledge and consent that your Interview Content will be:
5.3 Recruiter Access: You understand that your Interview Content will be shared with the Recruiter who invited you to interview and may be used as part of their recruitment decision-making process.
6.1 Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms.
6.2 We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
6.3 You acknowledge that the Recruiter may be the data controller for your Interview Content and may process it according to their own privacy policies.
During your interview, you agree to:
8.1 You understand that AI technology is used to assist in the assessment process but should not be the sole determinant of recruitment decisions.
8.2 The AI transcription and scoring are automated processes that may not capture all nuances of human communication.
8.3 You acknowledge that final recruitment decisions should involve human review and are ultimately made by the Recruiter, not by Open CVNGN.
9.1 You retain any intellectual property rights in original ideas or concepts you share during your interview.
9.2 You grant Open CVNGN and the Recruiter a limited licence to use your Interview Content for:
9.3 The Open CVNGN platform and technology remain our exclusive property.
10.1 Subject to applicable law and the legitimate interests of the data controller, you may have rights regarding your personal data, including rights to access, correction, deletion, or portability.
10.2 To exercise these rights, please contact us using the details in Section 14 or contact the relevant Recruiter directly.
10.3 You have the right to withdraw from the interview process at any time before completion.
11.1 We provide the platform to facilitate interviews but are not responsible for recruitment decisions made by Recruiters.
11.2 To the maximum extent permitted by law, Open CVNGN shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
11.3 Nothing in these Terms limits or excludes liability for:
12.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
12.2 Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. The current version will always be available on our platform. By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms.
